At Leahy & Hoste, we represent clients — both individuals and families — who been harmed, injured or killed as a result of the carelessness or negligent conduct of another.

Personal injury cases are those in which the negligence of another results in physical harm or injury. Under the law, when a person is injured through the wrongful conduct of another he or she is entitled to recover money damages for items such as medical expenses, loss of wages, pain and suffering, disability and disfigurement.

Wrongful death cases are those cases in which the negligent actions of another causes a person's death. In such cases, the law provides that certain family members are entitled to damages for the lost monetary contributions which the deceased family member provided, as well as money damages for things such the loss of love, affection, society and companionship. In a wrongful death suit, a family member is seeking money damages for the death of a loved one.

Civil rights cases are those in which a person's constitutional rights have been violated, many times by an employer or the police or other government agency. Examples include police brutality, sexual abuse and wrongful prosecution and imprisonment.

Medical Malpractice
Medical malpractice, also called medical negligence, is the failure of a health care provider to follow accepted standards in the treatment of a patient. Not every case in which a patient is injured results in a case for medical malpractice, and a doctor or hospital can typically not be held responsible for a simple error in judgment. When such medical negligence results in a serious, permanent injury to the patient, a valid claim for medical malpractice may be pursued. Passenger or Commercial Vehicle Liability
Whether car, truck, boat or plane, the owner and operator of a vehicle has an obligation to make sure that he operates the vehicle in a manner that does not cause injury to another. If a passenger or commercial vehicle is operated in a negligent manner, it frequently can result in serious injury or death. Many times, involving commercial vehicles, an owner can be held legally responsible for hiring operators or drivers who are not adequately trained or have poor safety records. Product Liability
No product is perfectly safe in every circumstance, and just because a product plays a role in an injury does not mean the manufacturer can be held liable. But when a company knows or should know of a productıs dangerous propensities and ignores them for the sake of making a profit, a valid claim for product liability can stand if it results in a serious injury or death. Some frequent products involved in product liability litigation include both over-the-counter and prescription drugs (e.g. Vioxx), automobiles or their component parts (Firestone tires), and orthopedic implants.

Premises Liability
Property owners, especially owners of commercial establishments, are required under the law to ensure that their properties are safe for persons legally entitled to be there. Premises liability claims can run the gamut from failing to make sure that decks, elevators and escalators are safe, failing to keep walkways clear, or failing to ensure that there is adequate security. Leahy & Hoste have handled every type of premises liability claim and have the experience and resources to investigate the potential causes for such injuries.

Construction Injuries
When there is a safety lapse at a construction site, it can result in serious injury or death to persons working there or to others in the vicinity. Investigations into the causes of such injuries and affixing blame are complex and require an intimate knowledge of the many regulations and standards that regulate the construction injury. Sexual Abuse
Unfortunately, sexual abuse cases are not as uncommon as once believed. When a child (or sometimes even an adult) is sexually abused by or under someone with supervisory authority in a school, healthcare, daycare or religious setting, the child, through his parents or guardians, is legally entitled to compensation. Leahy & Hoste has successfully handled many such sexual abuse cases over the years. Many times the lawsuit and resulting settlement are handled confidentially to protect the abused victim from even more harm.

Police Brutality & Wrongful Prosecution or Imprisonment
The police and criminal prosecuting attorneys have a very difficult job, and usually are successful in enforcing the law without violating an individual's rights. When this power is abused, however, it can result in devastating injuries or losses of life and liberty. In recent years, with the advent of cameras in police cars and DNA sampling evidence, it has become easier for those persons truly wronged by the system to seek appropriate compensation for their wrongful treatment.
